Section One: Programme Commentary, RAG and Resources Update

Commentary

Overall the USG Other Programme is GREEN, as the projects are all on track.

The D&A Compliance with PECR, Etherington and GDPR (USG002) initiation was delayed to early August due to holidays. The Information Commissioner's Office is still not yet able to answer whether the University will be considered a public body, but a strong indication has been given that HEIs can use the basis of legitimate interest. The project will proceed with legitimate interest as the working principle, and risks raised for the potential that consent may need to be sought if this should change.

USG004 - the Apache Tomcat upgrade was successful and the Edinburgh Global Directory continues to be available for collaborations. The project is now closed.

AP67-071 - this project was withdrawn as the budget was allocated to other projects.

USG005 - The Student Alumni Platform project is GREEN, with the responses received and currently being evaluated. A follow-on project of 50d for the implementation is expected in 17/18.

USG006 - The Clearing 2017 project is GREEN, the SIMD functionality was made available to prospective applicants and has been used. The Scottish clearing was completed successfully on 8th August 2017, with a minor issue about phone hardware resolved on the day and updated for the rUK clearing scheduled for 17th.

Section Two: Projects Not Started

USG002 D&A - Compliance with PECR, Etherington & Data Protection Regulation

This project is to comply with three separate strands of regulatory changes:

  • The Privacy and Electronic Communications Regulations (PECR)
  • The Etherington review of how charities are regulated
  • The draft EU Data Protection Regulation

The above is core-funded work. It was previously expected that in addition there will be sponsor-funded work to migrate to the web based version of thankQ as estimated in USG001, this was confirmed as no longer in scope in July 2017.

The Information Commissioner's Office (ICO) has yet to clarify whether HE institutions will be deemed public authorities and, if they are, which of their activities will be covered. This would influence the decision about the legal basis for processing and is a blocker to identifying requirements. The D&A team are working with other institutions to jointly petition the ICO for clarity, and it was hoped that this would be reached before July to enable sufficient time to update the systems before the legislation comes into force in May 2018. The working principle for initiation is that HEIs can use legitimate interest as a legal basis for processing data for non-core activities, rather than consent.

The full 70d is now in the plan for 17/18 and so Risk12 has been closed. Risk 13 has been updated to consider the potential impact of the delay on the delivery of the functionality needed.
